The ultimate reason for THCA’s legality is the fact that the state does not follow the “total THC” rule that some states have employed.  Basically, some states do not permit sales of products containing more than 0.3% of any THC cannabinoid, including THCA.  Illinois is not one of the states that follows this rule, and so they do allow unlimited amounts of THC cannabinoids other than delta 9 (in hemp-derived products).  

So, what about marijuana, which remains a federally illegal substance, unlike hemp?  In Illinois, both recreational and medical marijuana use are completely legal.  As of January 1, 2020, anyone 21 or older can buy marijuana from a state-licensed dispensary without requiring a medical card.  One thing that is not legal in the state is home delivery – in other words, local businesses delivering cannabis to a resident’s home.

Residents who are 21 or older may possess up to 30 grams of cannabis flower, 5 grams of cannabis concentrate, or 500mg of THC-infused products such as edibles or oils.  Any adult who is visiting the state may legally possess half of those amounts.  Possessing beyond these limits is a misdemeanor, punishable by up to a year in jail, and a $2,500 fine.

Medical marijuana was legalized in 2013, and this law took effect in 2014.  Patients who qualify, and many do as the qualification list is quite extensive, can purchase marijuana at a state-licensed medical dispensary, and patients may purchase up to 2.5 ounces every 2 weeks.
