What is Delta 8 THC?

How is Delta 8 Flower Different from Marijuana?

In terms of chemical composition, delta 8 flower and marijuana flower are very similar, as are hemp and marijuana.  There is, of course, a legal distinction, since marijuana is federally illegal, and hemp flower is legal, as hemp naturally yields far lower, nonintoxicating levels of delta 9 THC.  

Delta 8 flower therefore has low levels of delta 9, to be federally compliant, but high levels of delta 8 to be somewhat similar on the psychoactive scale – and the terpene profiles of the two plants are identical.  One thing that does make it different is that delta 8 flower, coming from hemp flower, is going to contain a much higher concentration of CBD, as hemp yields high levels of CBD and marijuana does not.

What Makes Delta 8 Flower Federally Legal?

So, how exactly then, is delta 8 flower legal, if it’s chemically almost the same as marijuana?  Good question, as the answer would be the 2018 Farm Bill.  This piece of legislation permits that all hemp-infused products can be sold legally as long as they’re tested to verify that they contain no more than 0.3% delta 9 THC by dry weight.  But, here’s the thing: nowhere in the bill is delta 8 mentioned – delta 8 and delta 9 are two different cannabinoids.  So, there’s no limit on how much delta 8 may be infused into flower, or any hemp-based product, for that matter.
