Is THCA Flower Legal in Alabama?
Alabama does stick to the Farm Bill, meaning that they are not one of the states that outlawed banned THCA flower and all other THCA product forms. Like the Farm Bill, Alabama law does not limit how much flower a person can buy, how much they can possess or how strong the product can be in terms of it delta 8 content. The reason for THCA flower’s legality is the fact that the state does not follow the “total THC” rule that some states have employed – the same rule that lawmakers tried to pass in early 2021 and early 2022. Basically, some states do not permit sales of products containing more than 0.3% of any THC cannabinoid, including THCA. For now at least, Alabama does not follow this rule, allowing unlimited amounts of THC cannabinoids other than delta 9 (in hemp-derived products).
Is Marijuana Legal in Alabama?
So, what about marijuana, which remains a federally illegal substance, unlike hemp? For now, recreational use is completely illegal. In fact, marijuana laws are very harsh in Alabama for recreational users, since possession of any amount is a misdemeanor offense that can mean a fine of up to $6,000, and up to 12 months behind bars, for first-time offenders. A second offense counts as a felony, where there’s a mandatory minimum of one year of jailtime.
But, the state does operate a medical marijuana program, which was first passed by the Senate in March of 2020, but didn’t reach the House until much later due to disruptions caused by the COVID-19 pandemic that emerged at the same time. Finally, in May of 2021, medical marijuana was approved in the state.
In Alabama, patients who qualify for medical marijuana may be prescribed up to a year’s worth of marijuana by their physician at any given time. But, most edibles, flower, and vapes are not permitted for medical patients. As for edibles, they can only come in the form of gummies and lozenges, which may not be coated in sugar.
