So, where does that leave marijuana, which remains a federally illegal substance, unlike hemp?  In Minnesota, recreational marijuana is still completely prohibited.  But, the state has decriminalized possession, so that anyone with 42.5 grams or less of cannabis will only be fined $200, and not face jailtime.  Just know that this only applies to cannabis flower – possession of cannabis-infused products is treated as a misdemeanor.

At the same time, possession of anything above 42.5 grams of cannabis is a felony, leading to up to 5 years behind bars, and a $10,000 fine.  In 2019, a bill was introduced in an effort to make it recreationally legal, but it failed to go anywhere.  Another attempt was made in 2020, with the same results, this time due to complications caused by the COVID-19 crisis that was at its peak at the time.

Meanwhile, medical marijuana was legalized in 2014.  Patients with qualifying conditions, as determined by the state, can purchase cannabis products from a state-licensed dispensary, although cannabis flower is not permitted to be sold, along with edibles.  Patients are otherwise allowed to purchase up to a 90-day supply, as determined by their physician, of any other cannabis product type.
