What is HHC Flower?

  • Alabama: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  In Alabama, medical marijuana is also legal for qualifying patients, and possession of small amounts of marijuana has been decriminalized.  Marijuana has also not been decriminalized.  You will be charged with a misdemeanor for possession of any amount.  This can mean up to a year in jail and up to $6,000 in fines.  Attempts have been made to decriminalize it, but they have failed to pass.

  • Illinois: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state also permits sales of marijuana for both recreational and medicinal use.  Recreational use has been legal since 2020.  Delivery is prohibited.  Residents can possess up to 30 grams of marijuana, and 5 grams of concentrate.  Medical marijuana laws took effect in 2014.  Decriminalization took effect in 2016.
  • Indiana: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state’s cannabis laws are otherwise strict, with both recreational and medical marijuana banned.  Possession of any amount can mean up to 6 months in jail and a $1,000 fine.  Possession of more than that can lead to harsher charges.

  • Kansas: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  Otherwise, Kansas prohibits any hemp products containing more than 0% THC, and both recreational and medical marijuana use are banned.  Medical patients may purchase hemp products containing up to 5% THC, however.  Recreational users can face a misdemeanor for up to an ounce.  This can lead to a $1,000 fine and six months in jail.  Repeated offenses and higher possession amounts can lead to higher fines and jailtime.
  • Kentucky: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  Recreational marijuana remains illegal, and medical marijuana only became legalized in February of 2022, with no legal framework existing yet, meaning that medical patients cannot yet make marijuana purchases.  Patients can travel to other states with medical laws to purchase low-THC, high-CBD products with a note from a physician, however.  Possession as a non-medical patient means a misdemeanor for even small amounts, as cannabis has not been decriminalized.  But, Louisville has decriminalized up to half an ounce.  Otherwise, the result is only a $250 fine and up to 45 days in jail in the rest of the state.  
  • Louisiana: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  Medical marijuana is legal for qualifying patients, and recreational use remains illegal.  Recreational users with up to 14 grams can be fined up to $300, and imprisoned for 15 days, if they’re a first-time offender.  Otherwise, there may be harsher penalties.  Medical use was legalized in 2015.  Medical patients may purchase and possess up to 2.5 ounces every 2 weeks.
  • Maine: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state also permits sales of both medical and recreational marijuana.  Retail for recreational use began in 2020.  But, it was approved in 2016.  Recreational users can possess up to 2.5 ounces at a time.  Medical use has been legal since 2009.  Patients can also possess up to 2.5 ounces.
  • Maryland: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  When it comes to marijuana, medical patients can make purchases, as can recreational users.  Recreational use was legalized in 2022.  Retail will be available in 2023.  Recreational users can buy and possess up to 1.5 ounces, with 1.5 to 2.5 ounces being subject only to a fine.  Medical marijuana has been operational since 2017.  Patients may possess up to a 30-day supply of cannabis. 
  • Massachusetts: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  And, both recreational and medical marijuana are legal.  Recreational use was legalized in 2016.  Those 21 and older can have up to an ounce in their possession.  Small amounts were decriminalized in 2008.  Medical marijuana became legal in 2012.  Recreational sales began in 2018.

  • Minnesota: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  As for marijuana laws, medicinal use is permitted, but recreational is not.  Recreational users with 42.5 grams or less can face $200 in fines, but that’s it, because the state partially decriminalized cannabis.  A bill aimed to legalize recreational use in 2019, but was terminated.  Medical marijuana has been legal since 2014, with patients permitted to purchase and possess up to a 90-day supply.
  • Mississippi: HHC flower is considered illegal.  This means that businesses are banned from selling HHC flower.  And, online businesses are banned from shipping HHC flower to your home.  Mississippi permits medical marijuana sales, but has very strict requirements for qualification, while recreational use is very much illegal.  Medical sales have only been legal as of 2022.  Even so, voters were eager to approve it back in 2020.  Patients may possess up to 3.5 ounces per month.  For recreational users, possession of up to 30 grams means a $250 fine.  However, possession of a THC vape cart means 1-2 years in prison.  There is currently no legal framework for the state’s medical marijuana program.
  • Missouri: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  When it comes to marijuana, up until recently, only medical use was permitted for qualifying patients.  But, recreational use has been permitted since November of 2022.  Possession of up to 3 ounces is permitted.  No recreational dispensaries are open yet.  Medical patients have been able to buy marijuana since 2018.

  • Nebraska: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state strictly bans any hemp products containing more than 0% HHC flower, however.  And, only in July of 2022 did the state finally approve a medical marijuana program, while recreational marijuana use is still illegal.  Possession of up to an ounce is decriminalized, however, punishable by a $300 fine.  Selling is considered a felony.  
  • Nevada: HHC flower is considered illegal.  This means that businesses are banned from selling HHC flower.  And, online businesses are banned from shipping HHC flower to your home.  The state does permit sales of both recreational and medical marijuana.  Recreational use has been legal since 2016.  Sales went into effect in 2017.  Adults can possess up to an ounce at a time.  Medical use was legalized in 2000.  Adults with a medical card can possess up to 2.5 ounces of cannabis.  They can also possess up to 3.5 grams of concentrate.

  • North Carolina: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  Recreational marijuana, meanwhile, is illegal in the state, and for now, qualifying medical patients cannot purchase marijuana products containing more than 0.3% THC.  The state has not shown any sign of relenting in the near future.  However, small amounts are not subject to the harshest penalties.  Up to an ounce is punishable by a small fine and no imprisonment.  More than that can mean relatively low imprisonment times compared to other states, plus misdemeanor fines.
  • North Dakota: HHC flower is considered illegal.  This means that businesses are banned from selling HHC flower.  And, online businesses are banned from shipping HHC flower to your home.  While North Dakota allows for medical marijuana sales, recreational sales are completely illegal.  Medical use has been legal since 2016.  It wasn’t available for retail, however, until 2019.  At the same time, small amounts of possession – up to an ounce – became decriminalized.  Patients can purchase and possess up to 2.5 ounces of cannabis, and 400mg total THC in other product forms.
  • Ohio: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  As for marijuana, medical sales for qualifying patients are permitted, and small possession amounts have been decriminalized, although recreational use remains prohibited.  Up to 100 grams means only a $150 fine.  But, even medical patients cannot legally smoke or vape marijuana.  Medical patients can only purchase 2.83 grams of cannabis per visit to a dispensary.  They can possess up to 8 ounces, considered a 90-day supply.
  • Oklahoma: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state permits medical marijuana sales to qualifying patients, but recreational marijuana is still illegal.  Only in 2018 did medical use become legalized.  Patients can possess up to 8 ounces at home.  Recreational use has not been decriminalized, so even small amounts of possession can lead to big fines and jailtime.
  • Oregon: HHC flower is considered illegal.  This means that businesses are banned from selling HHC flower.  And, online businesses are banned from shipping HHC flower to your home.  But, both medical and recreational marijuana sales are allowed.  Recreational use has been legal since 2014.  The state also has a thriving dispensary industry.  Adults may privately possess up to 8 ounces at home, and up to an ounce in public.  Small amounts were decriminalized back in 1978.  Medical use was passed in 1998.

  • Tennessee: HHC flower is legal.  There aren’t any limits when it comes to what types of products may be sold.  Nor are there restrictions when it comes to the amount that can be purchased or possessed.  HHC flower can be purchased as long as you’re of adult age.  The state is very strictly anti-marijuana, however, with neither medical nor recreational sales allowed.  Patients with certain medical conditions can purchase low-THC, high-CBD products, however.  Still, these products are not available for retail as no dispensaries exist.  Possession of up to just half an ounce can mean a year in jail and a $250 fine.
